Core Pacific City (Living Mall) Case: Cross-Examination of Chu Ya-Hu on May 13

Speculation is not evidence, and fantasy is not a crime. That Ko Wen-je, was he sentenced by imagination? When the phrase “I think” can also be a reason for prosecution, who of us can still live in this land in peace? Even when he is in prison, Ko Wen-je still runs for others and always puts himself last. We do not see the righteousness of justice, but we see the light in him.

It’s not a crime — it’s brotherhood.

Despite being detained, Ko Wen-je remains as focused and diligent as ever, taking meticulous notes during the proceedings. He even gestured reminders when someone forgot to use the microphone, flashing his familiar, wholehearted smile.

His emotions peaked when speaking on behalf of Li Wen-Zong, asserting that Li had never served as the financial director of the Taiwan People’s Party nor had any involvement in the Core Pacific City (Living Mall) case. Li merely responded politely to a congratulatory message from Chu Ya-Hu about a donation and was subsequently accused and detained by prosecutors for nearly nine months based on false allegations. Ko, visibly emotional, pleaded with the judge to grant bail for Li, emphasizing the injustice of the situation.

Ko stated: “He is waiting for the truth.”

Verbatim Transcript – Ko Wen-Je Advocates for Li Wen-Zong:

“Chu Ya-Hu sent the same message and attachment to Li Wen-Zong, Tsai Pi-ru, and Chang Zhe-yang. Li Wen-Zong only replied out of courtesy, yet for this message… (choking up) he has been detained and incommunicado for nine months.

The prosecutors fabricated charges, falsely claiming in the indictment that the message was only sent to Li Wen-Zong, when in fact, all three received it. Li had already left the Taipei City Government over a year prior and was serving as the chairman of Taipei Metro Co. He had no involvement with the city’s affairs or the Taiwan People’s Party’s finances at that time. He only became the campaign finance director during my presidential run and never served as the party’s financial director.

For just that one message (choking up), he has been detained for nine months… (choking up) It’s a miscarriage of justice.”

Not Evidence, But Imagination; Not a Criminal, But a Scapegoat

Based solely on a witness’s speculation and imagination, and because Ko Wen-je consistently treats councilors and citizens with kindness, he has been unjustly detained for eight months.

Court Notes – Defense Attorneys for Chu Ya-Hu and Ying Hsiao-wei

After Chu Ya-Hu admitted in court last week that he was speculating and scrutinizing the dialogue between Sheen Ching-Jing and Ko Wen-je, he directly admitted today that when he was interrogated by prosecutors and anti-corruption officials, he said that “Ko Wen-je and Ying Hsiao-wei had a meeting to discuss Core Pacific Living Mall. ” It was all his imagination.

Ying Hsiao-wei asked, “You mentioned in the transcript of your interrogation by the anti-corruption officer that you heard that Ying Hsiao-wei had approached Ko Wen-je to discuss the case of Core Pacific Living Mall, and you said that Ying Hsiao-wei was a member of the parliament and could discuss it in any time, did they discuss the case?” Is it your personal speculation? Do you have any proof?”

Chu Ya-Hu: “It’s my personal speculation. I have no proof“.

Ying Hsiao-wei: “Have you seen it?”

Chu Ya-Hu: “I haven’t seen it. They can talk on phone directly, but I haven’t seen it with my own eyes, and if any councilman or councilwoman calls him, he will definitely answer it. I’m the deputy general liaison of the government, and I know he won’t say no.”

Judge Jiang Junyan fixed up the question: “As far as you know, did Ko Wen-je and Ying Hsiao-wei communicate on the phone?”

Chu Ya-Hu: “I haven’t seen the two of them talking on the phone, I don’t know.

Even Chu Ya-Hu confessed that it was Ying Hsiao-wei who went to pressure the civil servants of Taipei City and forced the civil servants to pass the case of Core Pacific Living Mall , but he also said that he didn’t know…

Was Chu Ya-Hu forced to confess after being improperly interrogated? Or was he intimidated and begged to get out, so he pleaded guilty and asked for a suspended sentence? What we have to ask, who took a witness’s “speculation and fantasy” as ironclad evidence and wanted to put Ko Wen-Je to death?

Concealing Evidence — or Justice Itself?

Today’s cross-examination revealed alarming issues. On September 27, during a late-night interrogation, prosecutors repeatedly questioned Chu Ya-Hu about a NT$2.1 million payment, suggesting it was a bribe from Sheen Ching-Jing. Zhu denied this multiple times. However, by the next day’s detention hearing, he suddenly confessed, stating: “The prosecutor’s words resonated with me, and I decided to take responsibility and confess.”

What exactly did the prosecutors say that night to prompt such a turnaround? Crucial conversations were omitted from the official transcripts. Only when Sheen Ching-Jing’s lawyer presented their own transcriptions of the interrogation recordings did these omissions come to light.

Despite requests to review the recordings in court, Taipei District Prosecutors Office’s public prosecutors obstructed the process with various excuses. Why are they preventing the restoration of truth? If they claim to be conducting a fair investigation, why not allow the court to examine the recordings and dispel doubts about potential misconduct?

We urge everyone to continue following Ko Wen-je’s case and strive together for justice in Taiwan’s judiciary.
